Will of Jane Caine alias Kaighin

 

Kirk Michael

 

At a Consistory Court holden in the house of Thomas Quine in the Parish Of Kirk Patrick on Thursday the 9th Day of December 1790.

 

     Jane Caine alias Kaighin of the Parish of Kirk Michael having departed this life in or about the Month of November last past Intestate and this Court having received Intelligence thereof have in Virtue and Pursuance of certain articles of Agreement entered into and duly executed by and betwixt Charles Caine, James Caine, Ann Caine and John Caine four of the Intestate's children and Daniel Caine her Husband dated 26th Day of November 1790 and hereunto annexed Decreed the said Daniel Caine sole adm..? of all the Goods Rights Credits Chattels and Effects of the said Intestate. The said John Caine having admitted that he had been provided for by a Deed of Settlement and it being alledged that Daniel Caine another Child of the Intestate who is now of the Isle had been advanced by a trade in the Life Time of his said Mother and he the said Daniel Caine Senr. is thereupon sworn well and truly to administer the Estate of the said Intestate and to pay all her just debts so far forth as her

Goods and Effects will exted and the Law bind him and to these Ends he hath given Pledges in Form of  Law namely The said John Cain his Son and John

Quiggen of the said Parish of Kirk Michael.

Know all men by these Presents that we Charles Caine James Caine & Anne Caine of Ballanaa in the Parish of Kirk Michael and Daniel Caine our brother being of the Island, and John Caine our Eldest Brother being the Heir at Law of the Estate of Ballanaa who had a Settlement from his Father and Mother previous to the Decease of his Mother by which settlement he is Excluded and Debarred from getting any right or share of Goods by the Death of his mother, which the said John Caine do Voluntarily of his own free Will and accord stand as Guardian or Trustee of his said absent brother Daniel Caine to join along with the rest of his Brethren and Sister in the stead and behalf of his said absent Brother Daniel Caine to see him Justice, Diverse good causes and reasons us

hereunto but chiefly and more Especially for and in consideration of the full and just sum of Twenty Four  Pounds of Good and lawful money ac cording to the currency of this Isle to be unto us paid and satisfied at or before the Worship-

ful Deemster or High Bailiff's attestation of these Presents at by and from the hands of our Father Daniel Caine, which said consideration Sum of Twenty Four Pounds we the said Charles Caine, James Caine, Anne Caine and John Caine do

receive from our said Father in Lieu of Whatsoever Share or Proportion of Goods and Effects which falls and descends to us by the Death of our Deceased Mother Jaine Caine alias Kaighin whop died Intestate and we the said Charles Caine James Caine, Anne Caine and John Caine in behalf of Daniel Caine, do by these Presents surrender exonerate yield up and aquit  unto our said Father Daniel Caine all and singular our whole Right and Title in and unto Whatsoever Goods and Effects, Cash, Credits or Demands which might fall to our share by the Decease of our aforesaid Mother he our said Father hereby taking upon himself to pay all the Debts and Expenses of our said Mother and that neither of us the said children before mentioned  be liable or accountable for any part or member of the Debts of the aforesaid Intestate and for the true perform..?

hereof we the said Parties and Persons before mentioned Do hereby Bind and Oblige themselves and their respective Heirs Executors Administrators and Assigns in and under the penalty or forfeiture of Forty Eight Pounds Ster.

to be levied and paid according to Law.

Quine of the Parish of Kirk Patrick 9th December 1790- Charles Caine, James Caine, Ann Caine John Caine and Daniel Caine the subscribing Parties to the before written Articles of Agreement acknowledge the same to be their proper Act and Deed Before us
