John Kaighin Jr. 1784

 

This is Affirmed to be the last Will & Testament of John Kaighin of Balnacregga in the Parish of K. K. Michael who departed this life on the 26 day of March 1784 who was weak in Body though of sound and perfect mind and memory at the time of making his will as herein after mentioned.

 

Primis. He committed his Soul to God and his Body to Christian Burial.

 

Item.  He devised and left unto Five of his Children Namely Charles, Catherine, Anne, Jane , and Esther the Legacy of seven pounds each, which … continue in the hands of their Mother until the said Children will arrive Severally to the age of Eighteen years and then their Legacies to be paid the girls & Charles to receive his Legacy at Fifteen yrs of age.

 

Item.  He Left and Bequeathed unto his Eldest Son John a little brown heifer, about a year old & two sheep as a Legacy.

 

Finally, He Nominated and Appointed his Loving Wife sole Executrix of all the Rest of his Goods, chattels and Effects movable and Immovable of what kinds or Denomination soever Excluding all other persons with a Six pence Legacy each _____

At a Chapter Court holden at K. K. Michael the 17th day of June 1784, Ann the Widow & the Executrix is sworn in Court in form of Law and also Guardian of her Children who are all under age & hath given pledge for the payment of Debts and Legacies viz. Daniel Lace of Jurby and Patrick Caley of Ballaugh.  Patrick Caley & Daniel Cain uncles by the father … are sworn supervisors.

                        The humble petition of Ann Kaighin

                        Widow of John Kaighin late of

                        Ball-ne Crigga in the parish of K. K.

                        Michael deceased.

 

Sheweth

            That the said John Kaighin lately departed this life leaving Six Infant-Children by … the eldest of whom is not more than eleven years old.

            That the said John Kaighin so departed this life without leaving any sufficient provision of personal Estate for the maintenance of His Children during their minority.

            That the said John Kaighin was at the time of his death possessed of the lands of Ball-ne Cregga … as an Estate of inheritance to the one half whereof the eldest son of the said John Kaighin is intitled in immediate possession as heir at law.

            That by the law of this Island, the said half of the said Estate in the possession of the said heir at law is subject to the one half of the maintenance of the said Children and you… as the natural Guardian of the said Children thinks it necessary to apply to your reverence to have the whole … sufficient portion of ye yearly … of the said estate for the maintenance of the said children (ascertained?) & awarded …

            Wherefore your … humbly prays that your reverence will be pleased to order the Sumner of K. K. Michael aforesaid to summon & give as a Jury of four good and Skilful persons to view estimate and report the yearly value of the said Estate and that the matters of this petition may come on to be heard at the next Chapter Court to be holden at K. K. Michael when & where the said Jury may … give in their report and that your reverence will be pleased to make such order on Judgment in the premes for the one half of the maintenance of the said children and the said half of the said Estate as to your reverence shall seem reasonable according to the circumstances of the Case.  And your … will Pray….             We whose Names Ensue Being a Jury Consisting of Four Men (Viz.) Thomas Camish, William Cannon, John Corlett, and William Corlett, Being Charged and Sworn by William Cannell Sumnor of K. K. Michael to view and Appraise the Deads Part of the Estate of Balnecregga in K.K. Michael and all the concerns of Lands thereunto Belonging.  We have Viewed Balnecregga aforesaid together with all the concerns thereunto belonging and do Estimate and Appraise the same to the sum of Thirty Seven Pounds Ten Shillings a Year.  The Deads part of the same being the sum of Eighteen pounds Fifteen Shillings a year and this we give for our Verdict this 5th of November 1784
